Terms
These Terms of Service (“Terms”) govern your access to and use of vuepod.net (the “Site”) and your purchase of VuePod products. The Site and products are offered by VuePod, a brand operated by SmartSF Technology Limited (“VuePod,” “we,” “us”). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
Eligibility
You must be at least 18 years old, or the age of majority in your location, and able to enter into a binding contract to purchase from us.
Products, descriptions, and pricing
We try to describe and display our products accurately, but we do not warrant that descriptions, images, colors, or other content are error-free. Prices are shown in U.S. dollars (USD) and may change at any time before you place an order. We may correct errors, inaccuracies, or omissions, and may change or update information or cancel orders if any information is inaccurate, including after an order has been submitted.
Orders and payment
Your submission of an order is an offer to buy. We may accept or decline your order, and we may limit or cancel quantities. Payment is processed by third-party payment providers; by submitting payment information you authorize us and our providers to charge the applicable amount. We do not store your full payment card details on our servers.
Shipping, returns, and warranty
Shipping, returns, refunds, and warranty are governed by our Shipping Policy, Return & Refund Policy, and Warranty, which are incorporated into these Terms.
The VuePod app and connected services
Using the VuePod camera requires a supported mobile app and a compatible Wi-Fi network. The app and any cloud or connected services are provided under their own terms and privacy policies, which are separate from these Terms. We are not responsible for third-party apps, networks, or services, or for interruptions to them.
Acceptable use
You agree not to misuse the Site, including by attempting to gain unauthorized access, interfering with its operation, scraping or copying content without permission, or using it for any unlawful purpose. You are responsible for using VuePod products lawfully and responsibly, including respecting the privacy of others.
Intellectual property
The Site and its content — including the VuePod name, logo, text, images, and design — are owned by or licensed to us and are protected by intellectual-property laws. You may not use them without our prior written permission.
User-submitted content
If you submit photos, videos, reviews, or other content to us (for example through a submission form or by tagging us), you grant VuePod a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content on our Site and marketing channels. You represent that you own or have the rights to the content you submit and that it does not infringe anyone’s rights.
Disclaimers
The Site and products are provided “as is” and “as available” to the fullest extent permitted by law. VuePod is an indoor viewing camera; it is not waterproof and should not be submerged or placed inside water. We do not warrant that the Site will be uninterrupted or error-free. Except as expressly stated in our Warranty, we disclaim all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose, to the extent permitted by law.
Limitation of liability
To the fullest extent permitted by law, VuePod and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Site or products. Our total liability for any claim relating to a product will not exceed the amount you paid for that product. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
Indemnification
You agree to indemnify and hold harmless VuePod and its operators from claims, losses, and expenses arising out of your misuse of the Site or products or your violation of these Terms.
Governing law and disputes
These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-laws rules. Any dispute will be resolved in the courts of Hong Kong, unless applicable consumer-protection law in your place of residence provides otherwise.
Changes to these Terms
We may update these Terms from time to time. Changes take effect when posted, and the “Last updated” date above will be revised. Your continued use of the Site means you accept the updated Terms.
